Is Online Poker Legal in Florida?

The road to legalizing online poker in Florida has been long and all too often confusing for players and platforms alike. While there are technically no fixed restrictions in place for online poker play, the matter still remains a grey area and the safest course of action is to assume that online poker is not yet fully legal in Florida.

While multiple bills have been submitted to legalize online gambling in the State of Florida, none have come to pass and for now, no online platforms are allowed to operate within state lines.

So, is online poker legal in Florida? No. However, there is a workaround for this. While there is still a way to go on the road to legalizing online poker, Florida-based players can play at any online casino offshore.

Florida Poker and Amendment 3

This amendment holds no sway on online poker today for Floridians, but is a part of a future landscape of gaming should this come to be legal. This amendment gives a voting right on a low level detail part of a future legal poker scene in Florida. This amendment was contested by the Poker Alliance when it was up for vote, but it came through with a majority of over 70% of the votes. This does not cover all the implications of this amendment, but it will make it hard for Florida to ever have a functioning poker scene, as it will make a vote necessary whenever a tweak of a game, or a rule change needs to take place.

Video Poker

Not to be confused with online poker, video poker is a different game altogether. Often referred to as “Poker Slots”, video poker is played on a computerized console, very similar to a slot machine. The game is loosely based on a five-card draw and ranges across various themes and titles, with differing payouts and minimum deposits. Unlike standard slots, video poker still has a skill element involved, which makes it all the more enjoyable to play.

Like online poker, video poker is not regulated in the state of Florida and for that reason, is not yet legal. Video poker is however available to play at offshore casino sites on all of the above platforms. Once you’ve sided with your preferred offshore poker platform, registered your account and made your first deposit, you’ll be able to take a seat at any table and wager your stake.

Casual Poker

While playing online poker in Florida is still a grey zone, by and large, the law is slightly more lenient when it comes to “Casual” poker. Casual (or social) poker are unofficial games between friends, conducted in a safe environment for lower stakes.

As with all gambling practices in the United States, any person taking part in a casual poker game will need to be over the age of 18. Florida State has placed some pretty heavy restrictions on how casual poker games must be conducted. Casual poker players need to play on much lower hands than you would find in traditional casinos. These are known as “Penny-Antes” and have a $10 cap per hand or round played.

Sweepstakes and Social Poker in Florida

This is a form of poker that touches the gray area of being lawful. Basically, sweepstakes and social poker is a term used for sites that offer poker for a virtual currency. The reason it may not be fully legal under Florida law, is that you can win physical prizes on some of these sites.

Social poker, in the meaning home games are legal as long as you do not play for any kind of currency. So if you play for matchsticks, you are safe – but if you play for pennies – you are not.

Florida Poker Laws

Florida has some of the USA’s best and brightest casinos, with 77  destinations spread out across 31 cities. Playing poker in person is completely legal and there are no restrictions on gameplay, table limits or payouts. As long as the casino you’re playing in is a fully licensed gaming entity, you’re free to wager and win on any poker table you like. The same rules apply for racing and sports betting in FL, where dedicated, brick-and-mortar facilities are well within their rights to process wagers and release winnings. Just some of the leading poker action in Florida comes from Seminole Hard Rock Hotel and Casino, Daytona Beach Racing and Card Club, Magic City Casino, and Ebro Poker Room and Racebook, among others.

You can also get together with a group of friends and play casual poker where the buy-ins are restricted ($10 maximum on any hand or round) and no one profits from the game itself or the takings generated. If you want to get technical, you could argue that, especially now in the age of Covid, these casual games could be played online, but you’ll really need to do your research on the Florida state penal code to make sure you stay in the clear.

Offshore Poker Sites in Florida

If you’re in Florida and would like to wager real money with the best online poker titles, then offshore is your only option. Although online gambling is not permitted in the state, offshore sites fall outside federal jurisdiction and operate in a legal grey area so while they are not technically legal, they are also not illegal.

No one has ever been prosecuted in the state for using gambling at an offshore site, however, there has been legal action against a lawyer in Florida in 2001 who was participating in the running of an offshore gambling site and moving money between US bank accounts and offshore accounts.

With the above said, it always pays to do your research and understand your home state’s regulations around online poker. Read up on the latest laws to ensure that any gambling activities you take part in are above board and in accordance with the governing regulations of your state.

Offshore VS US Legal Poker Rooms

Lets look at the general state of things when it comes to legal vs offshore poker rooms. First of all, we need to get rid of one misconception: offshore poker rooms are legal poker rooms. They simply fall under a jurisdiction outside of the US.

What Signifies an Offshore Poker Room

The term offshore simply means the license is under a jurisdiction offshore, and can be under Maltese, Curacao’s or Panama’s jurisdiction. If the poker room have a gaming license, it falls under a law even if not under US law.  So in short: It has a license under a jurisdiction outside of the US.

What is the Key Difference Between Offshore and Legal Poker Rooms

For players, the main difference are, but not limited to: payment options, availability and ease of contest a decision by law.

  1. Payment Options: Some of your preferred payment options are not available outside of US. Some have Visa or MasterCards who are not usable outside of the states.
  2. Availability: When a state decides to ban online poker or online gambling, some of the bigger poker room operators have decided to withdraw from that state, and no longer accept players who lives in that state.
  3. Contesting decisions by law: If some dispute would need a lawyer, you need to make sure that lawyer is familiar not only with US laws, but with the laws of the jurisdiction the poker room has its license.

Is it Safe to Play at Offshore Poker Rooms From Florida?

Yes, it is safe to play at any of the offshore brands. As we mentioned before, as long as the site has a license they are safe to play at and are fair. It is not an insignificant cost to acquire a gaming license, and the poker rooms value them highly – and will not risk their licenses. The licenses safeguard that the poker rooms have up-to-date security and are as safe as any US-licensed poker room.

Benefits of Playing Poker Online vs Land-based Casino

It is possible to play land-based casinos in Florida and there are around 30 poker rooms in the state so why should you play online poker? Well, the first reason is that Florida is a large state and it may be a long drive to the nearest brick-and-mortar poker site. Even when you get there you may not be able to find a seat at a table.

If you gamble at home online it’s much more convenient as you can always find a seat at whatever kind of poker game you are after and with varying limits to match whatever works for you, games are available 24/7 and you don’t even have to get dressed to play. What’s more at online poker sites there are big bonuses available as well as free entry to tournaments.

Online Poker Guides State by State

Online Poker Florida Laws

Can you play online poker in Florida? The online poker scene in Florida is not as simple. While the general law around online gambling has never specifically singled out online poker play, the general consensus is that playing poker online within the State of Florida is, until further notice, illegal. The same goes for video poker or any other form of poker where money is wagered, exchanged, and/or won online.

However, offshore gambling sites are able to circumnavigate these regulations and keep their poker suites open 24/7 for players from Florida. The casinos hold offshore licenses across various regions, like Costa Rica, Malta, Gibraltar, Isle of Man and similar. They are fully regulated gambling entities situated on foreign soil, meaning they are not bound by the United States gambling regulations and restrictions. In fact, these offshore casinos are by far the easiest and safest destinations for Florida residents to play online poker.

A number of these offshore destinations process deposits and withdrawals in Bitcoin and other core cryptocurrencies, meaning you’re able to wager and win quickly and anonymously without ever having to move your takings through a third party. Keep in mind though that the legal gambling age in most major countries is 18 years and over and no person will be able to open an offshore casino player account without verifying their date of birth.

History of Gambling in Florida

Gambling in Florida has a long history and has seen many ups and downs. The first form of gambling to be legalized in Florida was pari-mutuel horse and dog racing in 1931. Although dog racing was banned in the state as of 2021, but residents can still bet on Horse racing. 1935 saw slot machines legalized in the state but this law was later repealed in 1973.

The late 1970s saw the first Indian casino open in the state where high-stakes bingo was available. In the late 1980’s lottery became legal in the state as did mall stakes poker games at home as well as more forms of gambling at Indian reservations due to the federal Indian Gaming Reservation Act.

2021 saw online sports betting legalized in the state but it was short-lived. After Gov. Ron DeSantis signed a new compact with the Seminole tribe that would have seen some form of legal online sports betting. However, local groups mounted a legal challenge claiming that it violates a constitutional amendment and that it violated the Indian Gaming Regulatory Act. The legal battle is ongoing and as of early 2023 online sports gambling is still not legal.

While many forms of in-person gambling are legal in the state in some forms, online gambling is still illegal for sports betting, casino games, and poker and as such there are no domestic options for these forms of betting.

Florida Online Poker

While playing poker in person is great for a night out, it’s not always practical. More often than not the variety of bonuses, frequency of tournaments, and game variety found online, far outweigh real-world casinos. Here are some of the core benefits of playing poker online.

Online Poker, Anywhere, Anytime.

You can play online poker 24/7 from almost any device. All of the above online casinos have dedicated poker rooms that can be used on both Android and iOS, meaning real-money wagers are always just a few clicks away.

Variety of Games

Even the world’s largest brick-and-mortar casinos have only so many poker tables for players to wager on. These tables are usually restricted to core poker titles and the limits don’t differ too heavily from one match up to another. With online poker; the sky is the limit. With poker variants across every imaginable stake and buy-in.

Top Tournaments on Tap

Whereas real-world casinos offer core poker tournaments at certain times in a month, online poker rooms roll out micro tournaments almost every hour of the day. You can enter smaller tournaments without having to wait an eternity for the right game to come along. Casinos like Ignition, BetOnline or Everygame have a bunch of different weekly tournaments with low buy-ins and high payouts, including Big Bad Beat, 10K Turbos, Sit & Go Windfalls, and more.

Learning Portals

Online poker portals have a wide range of tutorials and how-to guides for getting the upper hand in online poker. This is a great way to perfect your game and get to grips with hand rankings and other core strategies before playing for real.

Leading Incentives and Promotions

Online poker casinos have a near endless list of promotions and incentives. These poker rooms offer top Welcome Offers for new players (like BetOnlines 100% deposit match up to $1000) and regular cashback rewards, free chips, or reload bonuses that make your wagers go further.

Free Play Mode

One final incentive that you’ll likely never find in a land-based casino is the option to play online poker in Free (or Practice) mode. Players can perfect their strategy and learn the ropes in preparation for tournaments and cash tables.

The Benefits of Playing in the Best Online Poker Real Money Florida Sites

The benefits are pretty clear, ever since the online poker boom started in the late 90’s it has been the favorite of both the professional and recreational player. The latter has an easier time playing, as the best hands are presented in text and the game is automated with blinds and ante.

For the professional player it is a matter of speed and opponents. Where online, playing in a tournament along with 3 cash game tables is perfectly possible – it is impossible at a physical poker game. And if you want to hide your identity this is ever so easy online, where most poker room offer anonymous tables, allowing the skill to shine without anyone pointing the professional player out as a shark.

Online Poker VS Live Poker in Florida

As we mentioned above, there are several factors that may be beneficial for a player to spend their time online. But lets not forget that there are other factors that will appeal to some players when it comes to live poker. Mainly it concerns the social aspect of playing poker. Just as the online poker has speed, the live poker allows for the reading of peoples faces and micro expressions. This is not to be sneezed at, even if it comes at a cost of hands played per hour, it will benefit a certain type of player to take their game live.

Since there is no live poker allowed in Florida, you have to go to one of the reservations casinos to play if you want to enjoy the live version.

Florida Poker Apps & Mobile Sites

Playing online is a major part of the poker scene in Florida, and fortunately all of the offshore brands we present here has a way to play either at a browser version in your  mobile or by a downloadable app.

All the apps are well adjusted for a quick and easy hand of poker, it is mainly a matter of finding an app that suits you. Most of them look and function the same ways, with some small differences and of course: the name on the table.  Our favorite is Everygame poker app, that is connected to the Horizon network with a cash game open any hour of the day, regardless of state or time zone.

Tips for Real Money Online Poker – Florida

As we reach the end of our online poker casinos: Florida review, here are some of the top tips you should keep in mind for your next game of online poker.

  • Analyse your Starting Hand: If you’re dealt a weak starting hand, don’t be afraid to fold and rejoin the game when your cards are stronger.
  • Hand Rankings and Odds: Try to learn the basics of how the starting hands rank in the game flow. This means constantly evaluating your hand during the game. It might sound like rookie advice, but even skilled players overplay their pocket aces.
  • Avoid Side Bets: Keep your focus on the game and, wherever possible avoid making side bets. Keep in mind that the house edge is usually quite high on progressive jackpots and other side bets, so avoid them as a rule.
  • Start with Low Stakes Games: Playing low-stakes games is a great way to build up your bankroll without falling out of pocket. Especially true for beginners, playing low-stakes games gives you time to learn the ropes and feel more confident at the table.

Poker Games to Play in Florida

Whether you are playing poker online or at a land-based casino you can find multiple variants of poker games. There two most popular and most common types of poker you are likely to come across are Texas hold ’em and Omaha but there are multiple other types available. Below we will list the poker games that can be played in Florida and some essential information about each one.

Texas Hold ’em: The most popular poker game around. In Texas Hold’em players are dealt two hold cards. The player left of the dealer has to input a small blind and the next player a small blind. In some games, there may be an ante for every player.

The betting then begins. Once the first round of betting has finished three community cards are shown (known as the flop). Another betting round begins and then a fourth card is dealt (the turn) and after betting again the final card (the river) is dealt. The winner is determined by whoever has the best 5 card hand made up of a combination of their hole cards and the community cards.

Omaha: Omaha is very similar to Texas hold’em with two main differences. The first is that players are dealt four hole cards instead of two. The second is that your final hand is made up of exactly two of your hole cards and three of the community cards.

Omaha Hi-Lo: This variation of Omaha poker is almost identical to Omaha but with a little twist. In this version, the pot is split between the players that have the best hand and whoever has the worst hand.

Stud poker: Depending on the variant of stud poker being played players will be dealt a number of cards either face up, face down or a combination of both. Betting rounds in stud poker are commonly referred to as “streets”. After the final betting round, the player with the best hand will win. Although there are some variations like Hi-Lo or Razz where the worst hand can win. Below are some stud poker variations.

  • 5 card stud
  • 7 card stud
  • Mississippi stud
  • Caribbean stud
  • Razz
  • Hi-Lo stud

5 card draw: Players are dealt five cards face down and a round of betting begins. Once the first round is over if more than one player remains then players can discard 1-5 of their hole cards and replace them with cards from the deck. Many sites and casinos have a house rule of being able to discard only 3 cards or 4 if one of the cards is an ace or wild. Another round of betting occurs before hands are revealed.

Horse: Horse poker is actually an acronym of the five variants of poker involved in the game which are Hold’em, Omaha, Razz, Stud, Eight or better. One round of each of its component games is played, starting with Texas hold ’em and ending with eight or better. After the final round is complete it goes back to Hold’em.
